The above provide a sample of some of the questions you may have to answer when completing the forms at These can help you prepare by giving you an idea of the sort of information you will need to provide. Note, these are not a full list of questions, and the exact questions you will be required to answer will depend on individual circumstances.

Designation of Agent for Body Disposition Forms
An authorizing agent is someone with the authority to make decisions regarding what happens with the deceased. This person is usually next-of-kin (a relative), but sometimes is another person who has been given this authority by an official document; i.e. a decedent’s Last Will and Testament or a Designation of Agent for Body Disposition (DABD).

The authority of any person designated in a decedent’s will or by a DABD always supersedes that of next-of-kin (NOK); i.e. they take priority over everyone. Be aware that for those with “power of attorney” over an individual, legal authority expires when that individual passes, and they are no longer entitled to make decisions as authorizing agent.

If you would like to use a simpler DABD form to designate an authorizing agent and you reside in either New Jersey, New York or Pennsylvania, select one of the links below, and print out and complete the relevant form.

New Jersey - Designation of Agent for Body Disposition
Pennsylvania - Designation of Agent for Body Disposition
New York - Designation of Agent for Body Disposition

If you would like to create a Last Will and Testament to designate someone other than a traditional next-of-kin family member as your authorizing agent with legal control over the disposition of your remains, we recommend NOLO, a leading provider of legal do-it-yourself products.
